LONDON & PARTNERS STANDARD COMPETITION TERMS AND CONDITIONS

These competition terms and conditions apply to all competitions promoted by the Promoter.

By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

If you do not agree to these terms and conditions please do not enter the competition.

  1. THE PROMOTER

The promoter is London & Partners Limited, a company limited by guarantee, incorporated in England and Wales under company number 07493460 and whose registered office address is at Level 6 2 More London Riverside, London, SE1 2RR.

  1. THE COMPETITION

2.1              The competition will run from 00:01 on the date specified in the competition tweet to 16.00 on the date specified in the competition tweet (the “Closing Date”) inclusive.

2.2              All competition entries must be received by the Promoter by no later than 16.00 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

2.3              You can enter the competition in the ways described in the competition tweet and the winner(s) will be selected in the manner described on the competition tweet. 

2.4              No purchase is necessary and there is no charge to enter the competition.

2.5              The Promoter will not accept:

2.5.1          responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

2.5.2          proof of posting or transmission as proof of receipt of entry to the competition.

  1. ELIGIBILITY

3.1              The competition is only open to any person aged 18 years or over, except:

3.1.1          employees of the Promoter or its holding or subsidiary companies;

3.1.2          employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

3.1.3          members of the immediate families or households of (a) and (b) above.

3.2              There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

3.3              In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize(s) you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

3.4              The Promoter will not accept competition entries that are:

3.4.1          automatically generated by computer;

3.4.2          illegible, have been altered, reconstructed, forged or tampered with;

3.4.3          completed by third parties or in bulk;

3.4.4          photocopies and not originals; or

3.4.5          incomplete.

3.5              The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

3.6              Competition entries cannot be returned.

  1. THE PRIZE(S)

4.1              The prize(s) are supplied by the supplier(s) identified in the competition tweet (if any).

4.2              Unless otherwise stated in the competition tweet, the prize(s) do not include accommodation, upgrades, travel insurance, medical insurance, the cost of transfers to and from airports or stations, food and drink, spending money, car parking charges, lounge access, excess baggage, excursions, attractions, the cost of any visa or travel document, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize(s) are the responsibility of the winner(s).

4.3              Prize(s) are subject to availability. There is no cash alternative for the prize(s).

4.4              The Promoter and the suppliers reserve the right to replace the prize(s) with an alternative prize(s) of equal or higher value if circumstances beyond the Promoter's and/or a supplier’s control makes it necessary to do so.

4.5              The prize(s) are not negotiable or transferable.

4.6              In order to claim the prize(s) you must follow the instructions set out in the competition tweet.

4.7              The prize(s) may not be used in conjunction with any other promotion offered by the supplier of the prize(s) or any third party.

4.8              The prize(s) may not be claimed by a third party on your behalf.

4.9          The Promoter does not accept any responsibility if you are not able to take up the prize(s) for any reason.

4.10            The prize(s) may not be the subject of any claim of any nature whatsoever by the winner(s).

4.11            The total value indicated for the prize(s) (if any) set out on the competition tweet is only given by way of a guide and is subject to change. It is the equivalent of the retail price including VAT of the goods and/or services offered and as practiced or estimated as on the opening date of the competition.

4.12             London and Partners have the right to withdraw the prize should the winner be seen to be selling the prize

  1. WINNER ANNOUNCEMENT

5.1              The winner(s) of the competition will be announced in the manner set out on the competition tweet.

5.2              The decision of the Promoter or the judges nominated by the Promoter (if applicable) is final and no correspondence or discussion will be entered into.

5.3              The Promoter will contact the winner(s) personally by email and/or by telephone as soon as practicable after the Closing Date, using the email address and/or telephone number provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted. If the winner(s), once contacted by email and/or by telephone, fails to respond within a period of 48 hours following the date on which the email is sent or telephone contact was made notifying him or her of the prize(s) the prize(s) will be relinquished and the Promoter reserves the right to offer the prize(s) to the next eligible winner(s) selected from the correct entries that were received before the Closing Date.

5.4              The Promoter will send the name of the winner(s) to anyone who writes within one month after the Closing Date of the competition requesting details of the winner(s) and who encloses a self-addressed envelope to the address set out in clause 1 and the name of the winner(s) will be available on request at the offices of the Promoter set out in clause 1 for a period of 30 days.

  1. LIMITATION OF LIABILITY

Insofar as is permitted by law, the Promoter, its suppliers or agents will not in any circumstances be responsible or liable to compensate the winner(s) or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize(s) except where it is caused by the negligence of the Promoter, its agents or suppliers or that of their employees. Your statutory rights are not affected.

  1. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

7.1              All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

7.2              By submitting your competition entry and any accompanying material, you agree to:

7.2.1          assign to the Promoter all your intellectual property rights with full title guarantee; and

7.2.2          waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

7.3              You agree that the Promoter may, but is not required to, make your entry available on its tweet and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry for such purposes.

  1. DATA PROTECTION AND PUBLICITY

8.1              If you are the winner(s) of the competition, you agree that the Promoter and its suppliers may use your name, town of residence, image and any social media profile to announce the winner(s) of this competition and for any other reasonable and related promotional purposes.

8.2              You further agree to participate in any reasonable publicity required by the Promoter.

8.3              By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition.

8.4              GENERAL

8.5              If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

8.6              The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

8.7              These terms and conditions will be governed by English law, and both you and the Promoter submit to the non-exclusive jurisdiction of the courts of England and Wales.
